DUI Driver Pleads Guilty to Injuring Motorcyclist, 67

A New Jersey man pleaded guilty today to aggravated assault while driving under the influence in an Oct. 12 collision that left a 67-year-old motorcyclist seriously injured.

Timothy J. Babbitt, 39, of Shamong, NJ, also pleaded guilty to recklessly endangering another person, driving under the influence and reckless driving.

Bucks County Common Pleas Court Judge Wallace H. Bateman Jr. deferred sentencing to allow a presentence investigation of Babbitt to be conducted.

The victim, Vicky Mazzocca of Warminster, was riding her motorcycle in the southbound lanes of Route 611 in Doylestown Township when she was struck from behind by a Ford work van driven by Babbitt.

The impact threw the victim from the motorcycle, and she was pinned under the bumper of the van when Babbitt continued to drive after the impact.

Mazzocca was treated at Abington Memorial Hospital for multiple fractures, a concussion and pulmonary edema, injuries that required immediate surgery and which continue to cause her pain.

The defendant was taken to Doylestown Hospital, where tests showed his blood alcohol content to be .269 percent, more than three times the legal threshold for drunken driving in Pennsylvania.

Found in the center console of Babbitt's work van was a large Gatorade bottle found to contain an alcoholic beverage. Investigators also recovered a receipt from an Ottsville bar and restaurant showing that Babbitt had ordered six alcoholic drinks, three of them double vodkas, before departing less than a half-hour before the 3 p.m. collision occurred.

Investigators found no evidence of mechanical or weather issues that would have contributed to the collision.

The case was investigated by the Doylestown Township Police Department and the Bucks County Homicide by Vehicle Task Force; and prosecuted by Deputy District Attorney Robert D. James, Chief of the District Attorney's Homicide by Vehicle Division.
