Man Sentenced to 2 to 5 Years for Sexual Assault on Girl, 15

A young Sellersville man who sexually assaulted a 15-year-old girl after getting her drunk at his home was sentenced today to serve two to five years in state prison.

Austin Werner, 21, who was 20 when the crimes occurred, pleaded guilty in Bucks County Common Pleas Court on April 17 to aggravated indecent assault on a victim under 16 years old, indecent assault on a victim under 16, corruption of minors and furnishing liquor to minors.

According to court records, Werner gave two minor girls drinks from a two-liter soda bottle spiked with alcohol while they were at his residence last October.

When the 15-year-old became sleepy and ill, she lay on a bed in Werner’s mother’s bedroom. She told police that Werner kissed, groped and digitally penetrated her while she was in and out of consciousness and unable to move.

“I take full responsibility for my actions,” Werner told President Judge Jeffrey L. Finley before being sentenced. “I should never have been drinking or having people at my house (when) I didn’t know their ages.”

Werner’s sentencing had been deferred while the Pennsylvania Sexual Offenders Assessment Board evaluated him. The evaluation determined that Werner suffers from a paraphilic disorder and is likely to re-offend, thus meeting the criteria to be declared a sexually violent predator.

Werner and his attorney did not dispute that finding, and Finley declared Werner to be a sexually violent predator, subjecting him to lifetime registration with law enforcement as well as other conditions after his release.

Assistant District Attorney Jessica L. Bryant argued for a substantial sentence, saying that Werner, after getting the 15-year-old drunk, “took advantage of her while she was in that vulnerable state.”

Finley sentenced Werner to serve two to five years in state prison and imposed a concurrent five-year probation, telling him it “is clear that there is a risk to the community of your re-offending.”
